Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of TrackDeals (the "Service"), which is operated by DEVORAPPS LLC, a Virginia limited liability company ("DEVORAPPS", "TrackDeals", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

TrackDeals aggregates and curates publicly available deal information from third-party retailers. We are not a retailer and do not sell, ship, or fulfill any of the products listed. All purchases are made directly with the retailer, subject to that retailer's own terms.

Prices, availability, and product details displayed in TrackDeals are provided as a convenience and may not always be accurate. You should verify all information on the retailer's site before making a purchase.

3. Accounts

You must provide accurate information when creating an account. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at contact@trackdeals.app if you suspect unauthorized access.

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Scrape, crawl, or otherwise extract data from the Service in bulk or in violation of these Terms.
• Attempt to interfere with, disrupt, or compromise the security of the Service.
• Submit false, misleading, or infringing content (including deals you do not have permission to share).
• Use automated means (bots) to interact with the Service without our prior written consent.
• Resell, redistribute, or commercially exploit access to the Service.

5. Subscriptions and Memberships

TrackDeals offers free access and may offer paid memberships (e.g., VIP or per-store subscriptions). Paid memberships are billed through the Apple App Store or Google Play and are subject to those platforms' payment terms. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.

Promotional access (e.g., free VIP during launch) does not entitle you to continued paid features after the promotional period ends.

6. Affiliate Relationships

TrackDeals participates in affiliate programs and earns commissions when users purchase through links on the Service. See our Affiliate Disclosure.

7. Intellectual Property

The Service, including the TrackDeals name, logo, design, and original content, is owned by DEVORAPPS LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our prior written consent.

Retailer names, logos, and product images displayed in TrackDeals are the property of their respective owners and are used under applicable fair use or affiliate program guidelines.

8. User-Submitted Content

If you submit a deal or comment to the Service, you grant TrackDeals a worldwide, royalty-free, sublicensable license to host, display, and distribute that content as part of the Service. You represent that you have the right to share the content.

TrackDeals may remove user content at its discretion, including deals that appear inaccurate, expired, or fraudulent.

9. Third-Party Links and Services

The Service contains links to retailer websites and other third parties. We do not control and are not responsible for the content, policies, or practices of any third party. Your interactions with those third parties are governed by their own terms.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any deal listed is currently available at the stated price. To the maximum extent permitted by law, TrackDeals disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, TrackDeals and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid to us in the twelve months preceding the claim, or USD $50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless TrackDeals and its affiliates from any claim arising out of your violation of these Terms or your misuse of the Service.

13. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or for any other reason at our discretion. You may stop using the Service at any time by deleting your account.

14. Changes to the Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-law provisions. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in Virginia, and you consent to that jurisdiction.
